These Terms of Service govern access to sightforest.com and purchases from SIGHTFOREST.

By accessing the website or placing an order, you agree to these Terms and the policies incorporated into them, including our:

  • Return and Refund Policy;
  • Shipping Policy;
  • Privacy Policy;
  • Cookie Policy.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer law.

3. Eligibility

You must have the legal capacity to enter into a binding contract.

Where local law requires a minimum age, you confirm that you meet that age or that the purchase is made by an authorised parent or legal guardian.

4. Products

We make reasonable efforts to accurately describe and display our products.

Colours and appearance may vary depending on:

  • screen settings;
  • lighting;
  • manufacturing batches;
  • minor design updates;
  • accessories included for a particular market.

Product specifications may be updated where this does not materially reduce the product’s essential functionality or the customer’s statutory rights.

5. Lawful use of surveillance products

You are responsible for using cameras and related products lawfully.

Depending on your country and intended use, laws may regulate:

  • recording people;
  • recording audio;
  • surveillance of employees or public areas;
  • facial or biometric data;
  • placement of cameras;
  • warning signs;
  • data retention;
  • wildlife monitoring;
  • radio or SIM connectivity;
  • access to private property.

You must not use a SIGHTFOREST product to:

  • violate another person’s privacy;
  • conduct illegal surveillance;
  • record in prohibited locations;
  • harass, stalk or threaten another person;
  • facilitate a criminal offence;
  • interfere with communications or emergency services.

SIGHTFOREST does not provide legal authorisation for any particular installation or use.

6. Prices

Prices are displayed in the currency selected or detected by the website.

Unless the checkout expressly states otherwise, orders shipped from outside the destination country may be subject to import VAT, customs duties, customs clearance charges and carrier administration fees that are not included in the amount paid to SIGHTFOREST.

Before placing an order, customers must review the import notice displayed on the product page, cart, checkout or Shipping Policy.

7. DAP shipping and import responsibility

Unless expressly stated otherwise for a particular order, products may be shipped from China under DAP — Delivered At Place — Incoterms® 2020 conditions.

Under these conditions:

  • SIGHTFOREST arranges transportation to the stated destination;
  • the customer may be required to act as importer or consignee;
  • the customer is responsible for import clearance;
  • the customer is responsible for import VAT;
  • the customer is responsible for customs duties;
  • the customer is responsible for carrier brokerage, handling or administration charges;
  • the customer must provide information reasonably requested by the carrier or customs authority.

The amount of these charges depends on the destination country, product classification, customs value and carrier. SIGHTFOREST does not control the amount charged by customs authorities or carriers.

The use of DAP terms is subject to the actual customs declaration and mandatory applicable law.

8. Orders

Submitting an order is an offer to purchase.

We may accept the order by:

  • sending an order confirmation;
  • processing payment;
  • beginning fulfilment;
  • shipping the product.

We may refuse or cancel an order for legitimate reasons, including:

  • suspected fraud;
  • payment failure;
  • pricing or stock errors;
  • incorrect customer information;
  • sanctions or export restrictions;
  • inability to deliver;
  • suspected resale or unlawful use;
  • product unavailability.

If we cancel a paid order, we will refund the amount collected for the cancelled product.

9. Payments

Payment methods vary by country and are displayed during checkout.

Payments may be processed by Shopify, Shopify Payments, card networks, banks, digital wallets or other enabled providers.

You confirm that:

  • the payment details are accurate;
  • you are authorised to use the payment method;
  • sufficient funds or credit are available;
  • the payment does not violate applicable law.

10. Shipping and delivery

Shipping estimates are not guaranteed delivery dates.

Delivery may be affected by:

  • customs processing;
  • security checks;
  • incomplete addresses;
  • remote locations;
  • weather;
  • carrier disruptions;
  • public holidays;
  • force majeure events;
  • requests for import documentation.

11. Tracking

Where available, tracking information will be sent by email or made available through the order status page.

Tracking information may take several business days to update after fulfilment.

12. Cancellation

You may request cancellation within 24 hours after placing the order.

Cancellation is only possible if the order has not already entered processing, fulfilment or shipment.

Once fulfilment has begun, the order may need to be delivered and handled under the Return and Refund Policy.

13. Returns and refunds

Returns, refunds, statutory withdrawal rights and warranty claims are governed by our Return and Refund Policy.

European consumers retain all mandatory rights, including applicable withdrawal and conformity rights.

14. Refused customs charges

Where import charges were clearly disclosed before purchase, refusing to pay them may result in the parcel being:

  • delayed;
  • returned;
  • stored;
  • abandoned;
  • destroyed by the carrier or customs authority.

If the parcel is returned, any refund may be reduced by actual, documented and non-recoverable transportation, customs or handling costs, to the extent permitted by applicable law.

15. Product warranty and conformity

Products must conform to the description and mandatory legal requirements applicable to the sale.

Where a product is defective or non-conforming, the customer may be entitled to repair, replacement, price reduction or refund under applicable law.

Any commercial warranty is additional to and does not replace mandatory legal rights.

Damage caused by the following is not normally considered a manufacturing defect:

  • misuse;
  • incorrect installation;
  • unauthorised repair;
  • unsuitable power supplies;
  • water exposure beyond the stated protection rating;
  • accident;
  • impact;
  • vandalism;
  • improper storage;
  • use outside the specified operating conditions;
  • failure to follow instructions.

16. Connectivity and third-party services

Some products may depend on:

  • mobile network coverage;
  • Wi-Fi;
  • Bluetooth;
  • SIM cards;
  • third-party mobile applications;
  • cloud services;
  • data subscriptions;
  • third-party operating systems.

Availability and performance may vary by country, operator, location and network conditions.

Unless expressly included in the product description, mobile data, SIM plans, cloud subscriptions and third-party services are not included in the product price.

Third-party services may be governed by separate terms and privacy policies.

17. Website accounts

You are responsible for:

  • maintaining the confidentiality of account credentials;

  • activity performed through your account;
  • notifying us of suspected unauthorised access.

We may suspend an account where reasonably necessary to protect customers, the website or our legal rights.

  • designs;

Where you submit a review, photograph, video or other content, you confirm that:

  • you have the right to submit it;

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display the submitted content for operating and promoting SIGHTFOREST, subject to applicable privacy and consumer law.

  • attempt unauthorised access;
  • use automated systems in a harmful manner;
  • commit fraud;

Do not rely on an automated customer service response as legal, medical, safety or professional advice.

23. Disclaimer

To the maximum extent permitted by law, the website is provided on an “as available” basis.

We do not guarantee that:

  • third-party networks will always be available;
  • a camera will prevent crime, theft, trespass or property damage;
  • a recording will always be captured, transmitted or recoverable.

Nothing in this section excludes mandatory product conformity, consumer guarantee or liability rights.

24. Limitation of liability

Nothing in these Terms limits liability where it cannot legally be limited, including liability for:

  • fraud;
  • wilful misconduct;
  • death or personal injury caused by negligence where applicable;
  • mandatory consumer rights;
  • defective products where statutory liability applies.

Subject to those exceptions, SIGHTFOREST is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

Consumers retain any remedies available under mandatory local law.

25. Indemnification

To the extent permitted by law, business users agree to indemnify SIGHTFOREST against third-party claims resulting from:

  • unlawful use of the products;
  • illegal surveillance;
  • breach of these Terms;
  • infringement of third-party rights.

This section does not reduce the mandatory rights of consumers.

26. Governing law

These Terms are governed by the laws of:

Nothing in these Terms requires a consumer to waive a forum or remedy that cannot legally be waived.

28. Severability

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.

The version applicable to an order is normally the version in effect when the order was placed, unless a mandatory legal change requires otherwise.
